Terms of Service
These terms are the agreement between you and Cratchit Financial Services LLC ("Cratchit," "we," "us") for using Cratchit. By creating an account or using Cratchit, you agree to them. If you use Cratchit for a company or family, you agree on its behalf and confirm you're allowed to.
The short version. Cratchit is software that keeps your books and shows you options. It isn't a bank, a CPA firm, a law firm or an investment adviser, and it can't move your money. You decide what to do, and you check important decisions with your CPA or other professionals. Your data stays yours.
What Cratchit is
Cratchit is online software for business owners and their families. It keeps the books for your companies, reconciles and closes each month, prepares reports, estimates taxes, explains tax strategies using your numbers, forecasts cash, and tracks your family's goals, investments and estate documents.
What Cratchit isn't
- Not tax, legal, accounting or investment advice. Strategies, ratings, estimates and suggestions are educational. They depend on the information in your account and on laws that change. Before acting on any of them, confirm the details with your CPA, attorney or other qualified professional.
- Not a CPA firm, law firm or registered investment adviser. Cratchit doesn't file tax returns, sign opinions or manage investments. Your CPA still files your returns.
- Not a bank or payment service. Cratchit connects to your accounts read-only. It can't move money, pay bills or make trades. When Cratchit suggests a transfer, you make it yourself.
Your account
- You must be at least 18 and able to enter a binding agreement.
- Keep access to your email, and to your authenticator app if you use two-step sign-in, secure. You're responsible for activity by people you invite to your account.
- Account owners decide who else can see the account and what they can do. Removing someone ends their access.
- Give accurate information, and tell us at info@cratchit.io if you think someone has accessed your account without permission.
Your data
You own the information you put into Cratchit or connect to it. You give us permission to store, process and display it only as needed to run Cratchit for you, keep it secure, and meet legal obligations. Our Privacy Policy explains how we handle it. We never sell your data or use it for advertising.
You can export your information at any time. If you close your account, we delete your information as described in the Privacy Policy, except records the law requires us to keep.
Connected accounts
When you connect a bank, card, investment or loan account, you authorize Cratchit and Plaid to retrieve information from that institution for you. Plaid's terms and privacy policy also apply to those connections. We aren't responsible for an institution's or Plaid's errors, delays or outages, and connections sometimes need to be renewed.
AI features
Some features use AI to suggest categories, read documents and answer questions. AI can be wrong. Suggestions wait for your confirmation, and you should review what Cratchit records, especially before you rely on it for taxes or major decisions.
Your responsibilities
Cratchit is only as complete as the accounts and documents in it. You're responsible for reviewing your books, reports and tax estimates, for the decisions you make, and for what you and your CPA file. Keep your own copies of documents you're legally required to keep.
Fees and the pilot
- During the pilot, Cratchit is free. We'll give account owners at least 30 days' notice before any charge begins, and you can close your account before then without paying anything.
- Pilot members get their first three months free. If they choose to continue, they keep a founding price of $99 a month, with unlimited businesses and 20 connected accounts included (additional connected accounts are $10 a month for each 10), for as long as their subscription stays active.
- After the pilot, current prices will be shown on our website and in the app before you subscribe. Subscriptions renew automatically each month or year until you cancel, and you can cancel at any time effective at the end of the period you've paid for.
- Fees don't include taxes, which we'll add where required.
Acceptable use
Don't use Cratchit to break the law or anyone's rights; to access accounts or data you aren't authorized to; to interfere with or probe Cratchit's security; to copy, resell or reverse engineer the service; or to upload malicious code. We may suspend access to protect Cratchit, its users or the public.
Ending your account
You can stop using Cratchit and close your account at any time. We may end or suspend an account that breaks these terms, or stop offering Cratchit, with reasonable notice where we can give it. Either way, you'll have a reasonable chance to export your information first, unless the law prevents it. The sections on your data, disclaimers, limits on liability and disputes continue after an account ends.
Disclaimers
We work hard to make Cratchit accurate and available, but it's provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we don't promise that Cratchit will be error-free, uninterrupted, or that any strategy or estimate will produce a particular tax or financial result.
Limits on liability
To the fullest extent the law allows, Cratchit won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, taxes, penalties, interest or data, arising from your use of Cratchit, even if we were told they were possible. Our total liability for any claim relating to Cratchit is limited to the greater of the amount you paid us in the 12 months before the claim or $100. Some places don't allow these limits, so they may not all apply to you.
You agree to cover claims brought against Cratchit by others that arise from your misuse of Cratchit or your breach of these terms.
Disputes and governing law
North Carolina law governs these terms, without regard to its conflict-of-law rules. Any dispute will be heard in the state or federal courts located in North Carolina, and you and we consent to their jurisdiction. Before filing a claim, please contact us at info@cratchit.io so we can try to resolve it informally.
Changes and contact
We may update these terms as Cratchit changes. If a change is material, we'll tell account owners at least 30 days before it takes effect. Continuing to use Cratchit after that means you accept the new terms. If any part of these terms can't be enforced, the rest still applies. These terms and the Privacy Policy are the whole agreement between us about Cratchit.
